Terms of Service

When we say "Company" we are referring to Webtimeclock. When we say "Service", we mean the software products maintained by Webtimeclock. When we say "You", we are referring to the people or organization that owns an account with our Service.

When using the Service provided by the Company, you are agreeing to the latest Terms of Service. This also includes all existing Services and any future Services offered by the Company. If we do not exercise or enforce any right or provision of the Terms of Service, we are not waiving that right or provision.

Account terms

You are responsible for maintaining the security of your email address and password. The Company will not be liable for any loss or damage resulting from your failure to comply with this security obligation. We recommend using two-factor authentication with any email provider.

You must be a legal business that does not cause or promote harm. You must be a human. Accounts registered by automated methods are not permitted.

The Company reserves the right to terminate an account for reasons including, but not limited to, hacking, abuse, or threats towards the Service, Company, Company employees, or Company officers.

Payments and refunds

At the end of your 15 day trial, we will create your first invoice. If a balance is due, our Service will automatically charge your credit card. If no credit card is entered, we will pause your account until payment is made.

Invoices are based on usage: Time tracking is billed when employees track time. If none of your employees track time during your billing period, you will not be billed.

All fees exclude taxes, levies, or duties imposed by taxing authorities. You are responsible for paying all taxes, levies or duties depending on your locality. If the Company is required to collect sales tax, we will update these Terms.

All payments are non-refundable because they are based on usage. Also, note that any prepayments toward credit are non-refundable. Reach out to support if you believe there are special circumstances.

Cancellation, pausing, and termination

You can cancel your account at any time. To do so, log into your account, go to your account page, and use the cancel button. To cancel, you must be a lead administrator.

Paused accounts are locked from reporting when an invoice is unpaid. Your account will automatically activate once payment is made.

Account terminations are very rare, however the Company reserves the right to terminate your account for violating our terms.

Uptime, security, and privacy

Your use of the Service is at your sole risk. We provide the Service on an "as is" and "as available" basis. We do not offer service-level agreements for our Services. Historically, our Service availability has been over 99%.

We take many measures—including backups, redundancies, and encryption—to protect and secure your data.

When you use our Service, you entrust us with your data. We take that to heart. You agree that the Company may process your data as described in our Privacy Policy and for no other purpose.

You also agree the Company may access your data for:

  • Assisting with your support questions.
  • Fixing any errors that may occur.
  • Safeguarding from bad actors.
  • Any extent required by applicable law.

Liability

You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or any third party for any direct, indirect, incidental, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from:

  • the use or the inability to use the Service;
  • the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into - through or from the Service;
  • unauthorized access to or alteration of your transmissions or data;
  • statements or conduct of any third party on the Service;
  • or any other matter relating to these Terms of Service or the Service, whether as a breach of contract, tort (including active or passive negligence), or any other theory of liability.
